Terms and Conditions
Welcome to Pisoluck, an online raffle and gaming platform operated and maintained by Gavin Ventures Inc., fully licensed and accredited under the Philippine Amusement and Gaming Corporation (PAGCOR).
By using our services, players acknowledge and agree to be bound by these Terms and Conditions, including any updates, modifications, or additions. These Terms and Conditions apply to all participants and visitors of the Pisoluck platform.
1. Eligibility
1.1 Age and Residency: Participation in Pisoluck is only open to individuals who are at least 21 years of age and are legal residents of the Republic of the Philippines.
1.2 Prohibited Personalities:
- Employees, officers, and directors of Gavin Ventures Inc. and their immediate family members.
- Employees and contractors of PAGCOR.
- Individuals who are included in the National Database of Restricted Persons (NDRP).
- Individuals who have opted for self-exclusion with PAGCOR or through the Pisoluck platform.
- Foreign nationals and individuals residing outside the Philippines.
1.3 Any attempt to circumvent eligibility restrictions, including providing false information during registration, will result in the immediate forfeiture of account access and winnings in favor of the Philippine government.
1.4 Pisoluck reserves the right to require proof of eligibility at any stage through a formal Know-Your-Customer (KYC) process as mandated by PAGCOR. Failure to provide such proof may result in disqualification or account suspension until the said requirements are met.
2. Account Registration and Security
2.1 To access and use the Pisoluck platform, players must create an account using valid personal information, including a mobile number, email address and other related Personal Identifiable Information.
2.2 Players are responsible for maintaining the confidentiality of their account credentials. Any unauthorized use of your account must be reported immediately.
2.3 Upon each login, players will be required to read and accept the latest version of these Terms and Conditions. Refusal to accept will result in loss of access to the platform.
2.4 Pisoluck reserves the right to conduct identity verification at any time. Failure to comply will lead to account suspension.
2.5 players are limited to one account per person. Duplicate accounts are strictly prohibited and may result in termination of all associated accounts.
2.6 In cases of suspected identity fraud, Pisoluck reserves the right to freeze or suspend the account pending further investigation.
3. Gameplay and Raffles
3.1 Minimum Bet: The minimum allowable bet per ticket for any raffle draw is: Php 5.00.
3.2 Bets must be placed before the deadline indicated in each raffle draw. Late entries will not be processed.
3.3 Raffle draws will be conducted using a secure, random algorithm that complies with PAGCOR's technical and fairness standards.
3.4 Once a bet is placed and confirmed, it cannot be canceled or modified.
3.5 Pisoluck may cancel or reschedule a raffle at its sole discretion, with reasonable notice to affected players.
3.6 All entries are final and non-transferable. Pisoluck is not responsible for player mistakes, system errors, or failed transactions.
3.7 The odds of winning will vary depending on the number of entries for a particular raffle and are clearly indicated per event.
4. Forfeiture of Funds
4.1 All funds, credits, or prizes associated with accounts found to be held by ineligible or restricted individuals shall be immediately forfeited and turned over to the Government of the Republic of the Philippines in accordance with PAGCOR regulations.
4.2 Pisoluck reserves the right to withhold funds and investigate suspicious account activities without prior notice.
4.3 In the event that a prize has been mistakenly awarded to an ineligible participant, Pisoluck reserves the right to reclaim the prize or its equivalent value.
5. Responsible Gaming
5.1 Pisoluck promotes responsible gaming practices and complies with PAGCOR's responsible gaming initiatives.
5.2 players are encouraged to:
- Set personal betting limits.
- Take regular breaks from play.
- Seek professional help if they feel they are at risk of gambling addiction.
5.3 It is strictly prohibited to use the Pisoluck platform in public or open spaces such as schools, government offices, churches, or parks.
5.4 Tools for self-exclusion, temporary or permanent suspension are available upon request via our Customer Support.
5.5 Pisoluck reserves the right to monitor player activity and may intervene if problematic patterns are detected.
6. Acceptance of Terms and Conditions (T&C)
6.1 All players are required to accept these Terms and Conditions upon every login.
6.2 Continued access to the platform implies active acceptance of all provisions of the latest T&C.
6.3 Pisoluck may update these terms periodically. Notifications will be posted on the platform, sent via registered email/SMS or any other means subject to its full discretion.
6.4 It is the player’s responsibility to stay informed of any changes. Ignorance of updates shall not excuse violations.
7. Consequences of Violation
7.1 Violation of any provision in these Terms and Conditions will result in the following actions subject to the full discretion of Pisoluck:
- Warning notice for first-time, minor violations.
- Account suspension for moderate violations.
- Permanent account termination and forfeiture of credits or prizes in favor of the Philippine government for severe or repeated violations.
- Notification to regulatory authorities where applicable.
7.2 Pisoluck reserves the right to withhold any prizes or winnings while an investigation into player conduct is underway.
8. Prizes and Draw Mechanics
8.1 Prize Definition: A "Prize" refers to any physical or virtual good/s specified in each raffle draw that a raffle draw winner may receive. The Prize to be awarded to any winner cannot be substituted for any Prize of equivalent value, such as a cash prize, solely due to a request from a winner.
Pisoluck reserves the right to offer a cash alternative to the Prize specified in any of its raffle draws, and to offer a Prize of equal or greater value if for some reason the Prize is no longer available due to circumstances outside its control.
8.2 All prizes, whether in cash, products, or services, will be specified in each raffle draw details.
8.3 Winners will be determined via an auditable and random draw system and notified through their registered contact details.
8.4 Winners must claim their prizes within the specified period, usually within 60 calendar days from the draw date. Unclaimed prizes will be forfeited.
8.5 At least 1 government-issued ID and proof of identity are mandatory for prize collection.
8.6 Taxes and applicable government fees related to prizes are the sole responsibility of the winner.
8.7 All winners agree to allow Pisoluck to use their name, photo, and basic information for marketing or promotional purposes, unless a written request is submitted to opt out subject to the full provisions of the Data Privacy Act of 2012.
8.8 In case of any issues regarding the shipment of a physical prize that a player has won, Pisoluck will investigate and resolve the issue within 90 days from the date the issue was formally reported to Customer Support.
9. Limitation of Liability
9.1 Pisoluck shall not be liable for any damages arising from:
- Technical issues, server failures, or interrupted connectivity.
- Unauthorized access to player accounts.
- Inaccuracies in prize descriptions due to typographical errors.
9.2 In no event shall Pisoluck's liability exceed the total value of the player’s last successful bet.
9.3 The platform does not guarantee uninterrupted access to services and will not be responsible for any loss due to downtime, errors, or delayed draws.
10. Fair Play and Anti-Fraud Policy
10.1 Players are strictly prohibited from manipulating, hacking, or attempting to manipulate the platform.
10.2 Automated systems or bots used to participate in games are strictly forbidden.
10.3 Accounts found guilty of fraud, including collusion or use of unauthorized software, will be permanently banned.
10.4 Any suspicious behavior, including coordinated group activity or identity masking, will be investigated and may result in disqualification.
11. Modification of Terms
11.1 Pisoluck reserves the right to modify or update these Terms and Conditions at any time without prior individual notice.
11.2 Any changes will be deemed effective immediately upon posting.
11.3 It is the player’s responsibility to regularly review these Terms and Conditions.
11.4 Continued use of the platform after changes are posted will be considered as acceptance of those changes.
12. Governing Law and Jurisdiction
12.1 These Terms and Conditions shall be governed by the laws of the Republic of the Philippines.
12.2 Disputes arising from the use of the Pisoluck platform shall be resolved under the exclusive jurisdiction of Philippine courts.
13. Data Protection and Privacy
13.1 Pisoluck takes player privacy seriously and complies with the Data Privacy Act of 2012.
13.2 Player data will only be used for operational, legal, and marketing purposes with consent.
13.3 Information will not be disclosed to third parties without player permission, except as required by law.
13.4 players have the right to access, correct, or request deletion of their personal data.
